Important News: President Biden’s Latest Measures to Protect Families

We are pleased to announce that on June 17, 2024, President Biden introduced two major orders that could positively affect you and your family. Applications will open on August 19, 2024.

#1 Expansion of Parole in Place Program

President Biden and DHS announced a plan that promises to keep families together in the immigration process. Specifically, this initiative will offer “Parole in Place” to individuals who meet certain requirements. You may be eligible to apply for your green card without leaving the United States, if, as of June 17, 2024:

  • You are in the United States after entering without permission. 
  • You have lived in the United States for at least 10 years and have never left.
  • You are legally married to a U.S. citizen or have a qualifying stepchild relationship with a U.S. citizen.
  • You do not have certain criminal history or pose a threat to national security or public safety.

What This Provides for You

If parole is granted, it will be for a one-time period of three years. You may also be eligible for employment authorization for up to three years. With parole, you would be able to apply for permanent residency in the United States through adjustment of status through their U.S. citizen spouse, without the need to return to your home countries and seek an I-601A waiver for unlawful presence.

#2 For DACA beneficiaries and other Dreamers

President Biden will also offer streamlined access to employment visas for DACA beneficiaries and Dreamers. College-educated DACA recipients and Dreamers who are qualified for nonimmigrant status, such as an H-1B specialty occupation visa.

  • You have a degree from an accredited U.S. institution of higher education.
  • You have an offer of employment from a U.S. employer in a field related to your degree (or are already working in a field related to your degree).

What If I Already Have Another Case in Progress?

This program gives you another opportunity to pursue legal residency in a way that may be faster and more efficient for you and your family. Your existing case will not be negatively impacted and would continue up until you secure parole in place.
